  1. Please read this License Agreement before installing this software.  
  2. By installing this software, you indicate your acceptance of this 
  3. License Agreement.

  5. LICENSE RIGHTS AND RESTRICTION.  Terminal Reality Inc. grants to you 
  6. the non-exclusive, non-assignable right to use the Nocturne software 
  7. "Software" in object code form on a maximum of one (1) computer system 
  8. solely for your internal use and personal enjoyment.  The Software shall 
  9. not be copied or used for any other purpose.  You may not reverse engineer, 
  10. decompile, or disassemble the Software, except to the extent that the 
  11. foregoing restriction is expressly prohibited by applicable law.  You 
  12. may not sell, license, rent, prepare derivative works based upon the 
  13. software, or otherwise transfer the Software and accompanying written 
  14. materials. All rights not expressly granted herein are reserved by 
  15. Terminal Reality Inc.

  17. ADDITIONAL RESTRICTIONS.  Commercial use of the Software is prohibited.  
  18. You are not permitted or authorized to use the Software for commercial 
  19. purposes (ie. creation of additional scenery, aircraft, or cockpits 
  20. for resale or for profit).  
  21.  
  22. COPYRIGHT.  All title and copyrights in and to the Software and any 
  23. copies of the Software are owned by Terminal Reality Inc. This Software 
  24. is protected by copyright laws and international treaty provisions. All 
  25. rights not expressly granted herein are reserved by Terminal Reality Inc..
  26.  
  27. NO WARRANTIES.  The Software and accompanying written materials are 
  28. provided "as is", without warranty of any kind.  To the maximum extent 
  29. permitted by law, Terminal Reality Inc. disclaims all warranties, either 
  30. express or implied, including but not limited to implied warranties of 
  31. merchantability, fitness for a particular purpose and nonifringment.  
  32. The entire risk out of the use or performance of the Software and any 
  33. accompanying written materials remains with you. 
  34.  
  35. NO LIABILITY FOR CONSEQUENTIAL DAMAGES.  To the maximum extent permitted 
  36. by applicable law:  in no event shall Terminal Reality Inc. or its 
  37. publishers to be liable for any damages whatsoever (including, without 
  38. limitation, damages for loss of business profits, business interruption, 
  39. loss of business information, or other pecuniary loss) arising out of 
  40. the use of or inability to use the Software, even if Terminal Reality Inc. 
  41. has been advised of the possibility of such damages.  Because of some 
  42. states/jurisdictions do not allow the exclusion or limitation of liability 
  43. for consequential or incidental damages, the above limitation may not apply to you.

  45. MISCELLANEOUS.  If you acquired this product in the United States, this 
  46. Agreement is governed by the laws of the State of Texas.  If either party 
  47. employs attorneys to enforce any rights arising out of or relating to this 
  48. Agreement, the prevailing party shall be entitled to recover reasonable 
  49. attorneys fees, costs and expenses.
